Even if this is your first DUI offense within the past ten years, you could be sentenced to incarceration, loss of driving privileges, and expensive fines.Judges must abide by the “minimum mandatory” sentence when ruling on a case; however, he or she may elect to increase the penalties. For a DUI first offense, you could be sentenced to 10 days to 12 months in jail, with a minimum of 24 hours of actual jail time. You may also be required to attend mandatory drug and alcohol classes (“DUI School”).
If this is your first DUI offense within the past five years, you may be eligible for license reinstatement after 120 days upon completion of a DUI and Drug Risk Reduction program and paying the reinstatement fee to the Department of Driver Services. You may also obtain a limited driving permit during the suspension period. This limited permit allows you to drive to work, school, the doctor, and alcohol treatment programs. If you violate the terms of your limited permit, or are found guilty of any moving violation, your driving privileges will be revoked for six months.
