Cobb County DUI Second Offense

Penalties for a second DUI offense in Georgia are significantly more severe than for a first offense. If convicted of a second offense, you can expect large fines, mandatory jail time, attendance at DUI School, loss of driving privileges, and community service. However, with the right DUI attorney, you may be able to reduce or avoid these harsh consequences.

If convicted of a DUI second offense within ten years, the judge could sentence you to no less than 90 days or no more than 12 months in jail. While some of this time may be suspended, you will have to spend at least 72 hours in jail. You may also face 12 months of probation, less any time served. Fines ranging from $600 to $1000 could be levied, in addition to statutory surcharges. At least 30 days of community service must be served, and you may be required to attend DUI School, alcohol treatment, and clinical evaluation.

For a second DUI offense within five years, your license could be suspended for three years. However, you may be eligible for an ignition interlock permit after a 12-month hard suspension and completion of a DUI and Drug Use Risk Reduction program. An ignition interlock device works as a mini breathalyzer to ensure your blood alcohol content is under a permitted level before the vehicle will start. Upon successful completion of a clinical evaluation and a 17-week alcohol treatment program, you may be eligible to reinstate your full driving privileges after 18 months.

After a second DUI conviction, you will be required to surrender the license plates for all vehicles in your name. If a family member is dependent on your vehicle, you must order a special “DUI” license plate. And to add to the embarrassment, you must pay for your picture to appear in your local newspaper.
