Cobb County DUI Third Offense

Cobb County throws the book at habitual DUI offenders, with a DUI third offense garnering the most severe punishment. If you are currently facing a third driving under the influence charge, hiring a skilled DUI lawyer is in your best interest. Your attorney can represent you in both the administrative hearing and criminal case in an effort to secure a favorable outcome.

If convicted of a third DUI offense, you may be sentenced to no less than 120 days or more than 12 months of incarceration; however, the judge could suspend all but 15 days of jail time. Probation may be ordered for 12 months, but will be reduced if any actual jail time is served. You could also be ordered to pay fines ranging from $1000 to $5000, plus statutory surcharges. You may also be required to perform at least 30 days of community service.

After any DUI offense, drug and alcohol education classes may be part of the sentence. For a DUI third offense, you must attend DUI Alcohol or Drug Use Risk Program as well as an alcohol and drug assessment. If it is concluded that you have a serious problem, you may be ordered to complete a substance abuse treatment program.

A DUI third offense within five years could result in a five-year license revocation; however, after two years you may be eligible for a probationary license. Like a limited permit, a probationary license has conditions on when and where you may drive, and you will be required to install an ignition interlock device in your vehicle. You must also turn in the license plates for all cars in your name, though you can apply for a special license plate if a member of your household is dependent on your vehicle.

Don’t be under the mistaken impression that just because you have been arrested for a DUI third offense that you will be automatically convicted.
