Cobb County Underage DUI

In order to avoid the loss of these funds, Georgia has passed legislation making it a crime for drivers under the age of 21 to operate a motor vehicle with a blood alcohol content (BAC) of .02% or more (the limit for drivers over 21 is .08%). If an underage driver is found with a BAC above .02% but below .08%, he or she may be charged with Under 21 DUI. However, if an underage driver has a BAC of .08% or greater, he or she may be charged with a regular DUI in addition to Under 21 DUI.

The penalties for an underage driver with a BAC under .08% include 20 hours of community service and a six-month driver’s license suspension. If the driver’s BAC was over .08%, a 12-month license suspension may be imposed.

Please note that if an underage driver is arrested for drunk-driving before turning 21, a limited permit may be issued and the license may be reinstated after 120 days if the driver entered a plea on or after his or her 21st birthday.
